This website is operated by GustavDesign SIA. Throughout the site, the terms “we”, “us” and “our” refer to GustavDesign SIA. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions, including those additional terms and conditions and policies referenced herein or available by hyperlink. These Terms of Service apply to all users of the site.

1. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer over networks.

2. Products And Services

We specialize in custom marble items and furniture, including but not limited to bathtubs, sinks, tables, pedestals, and slabs. Marble is a natural material; therefore, variations in color, veining, and texture are inherent characteristics and shall not be deemed as defects. We reserve the right to limit the sales of our products or Services to any person, geographic region, or jurisdiction.

2.1. Raw Material & Fabrication Variance

For bespoke projects, our recommendations are based on an external examination of the raw stone. The Customer acknowledges that marble is a natural geological product; therefore, internal veining, color transitions, and natural inclusions are inherently unpredictable and cannot be fully verified until the block is sawn. By approving a block, the Customer accepts the inherent risk of natural variation. These unique characteristics discovered during fabrication shall not be deemed defects, nor shall they constitute grounds for rejection or refund.

2.2. Digital Representation & Physical Samples

All product photography, 3D renders, and digital media are for illustrative purposes only. Because screen calibrations vary, we cannot guarantee an exact color or contrast match. Furthermore, any physical samples or swatches represent only a small fraction of a larger stone block and cannot accurately depict the sweeping veins or larger color variations present in a full-sized product. The final product will not be an exact replica of any digital image or physical sample.

2.3. Natural Characteristics & Environment

Marble and travertine naturally feature pits, fissures, dry seams, and varying surface textures. Standard industry fabrication may involve using epoxy, resin, or stone fillers to stabilize the material; these fills are natural characteristics and standard techniques, not structural defects. Additionally, the appearance of your stone will shift significantly depending on its environment. GustavDesign SIA is not responsible for how natural sunlight, indoor lighting, or surrounding colors alter the visual perception of the stone in your specific installation space.

3. Modifications To The Service And Prices

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service.

4. Billing And Payment

We process payments through Shopify Payments and Stripe payment links. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

5. Intellectual Property Rights (Strict Enforcement)

All content included on this website—including but not limited to text, graphics, logos, product photography, and digital 3D renders—is the exclusive property of GustavDesign SIA. We hold full ownership of every photo and render displayed. You are strictly prohibited from copying, reproducing, or using any of our visual or intellectual assets without express written agreement. Any unauthorized appearance of our content elsewhere will be legally pursued to the fullest extent of the law.

6. Prohibited Uses

In addition to other prohibitions, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to infringe upon or violate our intellectual property rights; (d) to upload or transmit viruses or any other type of malicious code; (e) to scrape, crawl, or spider the site for any purpose; (f) for any obscene or immoral purpose.

7. Shipping And Risk Of Loss

We ship globally. For international delivery options not listed at checkout, customers must contact us directly. All items are fully insured by GustavDesign SIA and the designated cargo company during transit. All transit damage claims must be strictly processed according to the inspection and Bill of Lading (BOL) requirements outlined in our Return and Refund Policy. Failure to adhere to those receiving protocols will void transit insurance and replacement eligibility.

7.1. Delivery Conditions and Accessibility

Unless explicitly stated and invoiced as a specialized "White Glove" or inside-delivery service, all freight deliveries are strictly curbside delivery. The Customer is solely responsible for moving the item from the curbside into their residence or business. The Customer must ensure that the delivery location is accessible to large freight vehicles. Any failed delivery attempts due to inaccessible roads, unavailable receiving parties, or refusal of curbside terms may result in additional storage and redelivery fees at the Customer’s expense.

7.2 Post-Delivery Handling and Installation

GustavDesign SIA is not responsible for any damage that occurs after the delivery has been signed for and accepted. Natural stone is incredibly heavy and requires professional, experienced stone handlers for moving and installation. Any cracking, chipping, or breaking that occurs during the moving, hoisting, or installation process is strictly the liability of the Customer and their hired contractors. Furthermore, the Customer is solely responsible for ensuring their floor structure can support the weight of the stone product.

7.3 Bespoke Production Timelines and Delays

Due to the complex nature of sourcing, cutting, and milling raw monolithic stone, all production lead times provided by GustavDesign SIA are estimates, not guarantees. Unforeseen geological faults discovered during milling may require us to source new raw material, which can extend timelines. The Customer acknowledges that delays in the bespoke fabrication process or international ocean freight do not constitute a breach of contract and are not valid grounds for order cancellation or refunds.

8. Limitation Of Liability

In no case shall GustavDesign SIA, our directors, officers, employees, or affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind. Our maximum liability to you shall not exceed the total amount paid by you for the specific order giving rise to the claim.

9. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Latvia.
